Copyright and Takedown Policy

Last Updated: July 18, 2026

CRCO (PTY) LTD ("CRCO") respects the intellectual property rights of others and expects users to do the same. This policy explains how to report copyright infringement on the Platform and how we handle those reports. It is designed to comply with the South African Electronic Communications and Transactions Act, 2002 (ECTA) and, for users and rights holders in the United States, the Digital Millennium Copyright Act (DMCA).

Filing a Takedown Notice

If you believe content on CRCO infringes your copyright, send a notice to our Copyright Agent containing:

1

Your full name and physical or electronic signature

2

Identification of the copyrighted work claimed to be infringed

3

Identification and location (URL) of the allegedly infringing material

4

Your contact information (address, phone, email)

5

A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law

6

A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf

Designated Copyright Agent:

  • Name: Dillion Phiri
  • Physical/Postal Address: 38 Grosvenor Street, Phalaborwa, Limpopo, 1390, South Africa
  • Email: hello@oncrco.com
  • Subject line: Copyright Takedown Notice

Founder note: if CRCO is an ISPA member, confirm membership details — South African rights holders may submit ECTA takedown notices via the Internet Service Providers' Association (ISPA) at complaints@ispa.org.za (ispa.org.za/tdn). If not a member, ECTA safe harbor may not apply — discuss membership with counsel.

Founder note (US rights holders): CRCO's Designated Agent registration in the US Copyright Office's Designated Agent Directory can be verified at dmca.copyright.gov. Complete this registration (approx. $6, renew every 3 years) before publishing, or remove this line.

Warning: knowingly submitting a false or misleading infringement claim may make you liable for damages, including costs and legal fees (see DMCA §512(f) and ECTA §77(2)). Do not file a notice unless you are confident the use is infringing.

Our Process

1

Acknowledgment

We confirm receipt of your notice promptly.

2

Review

We check the notice for completeness and validity; incomplete notices may be returned with a request for the missing information.

3

Action

If the notice is valid, we remove or disable access to the material expeditiously.

4

Notification

The user who posted the material is notified and given a copy of the notice, and may file a counter-notice.

Counter-Notice

If you believe your content was removed in error or misidentification, you may file a counter-notice containing:

1

Your full name and physical or electronic signature

2

Identification of the removed material and where it appeared before removal

3

A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification

4

Your contact information (address, phone, email)

5

If you are in the United States: consent to the jurisdiction of the federal district court for your district. If outside the United States: consent to the jurisdiction of the courts of the Republic of South Africa

6

A statement that you will accept service of process from the person who filed the original notice

On receiving a valid counter-notice, we forward it to the original complainant. If they do not notify us within 10 business days that they have sought a court order against the alleged infringer, we may restore the material within 10 to 14 business days of receiving the counter-notice.

Note on regional differences: the 10 to 14 business day restoration timeline above is a DMCA (US) requirement. ECTA does not codify an equivalent counter-notice timeline; South African disputes are instead governed by ECTA's liability for wrongful takedowns (section 77(2)) and ordinary court processes, and may take longer to resolve. We apply the unified process above as a matter of platform policy.

Repeat Infringer Policy

CRCO will terminate the accounts of users determined to be repeat infringers. We track valid takedown notices against accounts, and multiple substantiated notices will result in warnings, suspension, and ultimately termination.
